Former Bribery DG goes to court against Ex-Minister

COLOMBO (News 1st); Dilrukshi Dias Wickramasinghe PC, the former Solicitor General at the Attorney General's Department and the former Bribery Commission Director General instituted legal action against former Cabinet Minister Rohitha Bogollagama claiming Rs.1 Billion damages also seeking an interim injunction restraining Rohitha Bogollagama from defaming her further and restraining him 

from disposing his assets without reserving Rs.1 Billion worth of assets.

When the above case which was filed by Dilrukshi Dias Wickramasinghe PC through her Attorney-at-Law G.G.Arulpmgasam, came up before Additional District Judge Maheshi de Silva today, Chandaka Jayasundara PC appeared on behalf of Dilrukshi Dias Wickramasinghe PC, and made submissions seeking to issue summons and in the first instance, only to issue notice of interim injunction on the Defendant and reserving the right to support for an enjoining order if necessary.

In the Plaint, it is stated that the Bribery Commission has issued notice on the Defendant to appear before the Bribery Commission in order to answer the allegations of bribery against him and that the Defendant has refused to come before the Bribery Commission and on an application by the Bribery Commission, the Supreme Court issued a rule on the Defendant, after which, the Defendant had come before the Bribery Commission and had given a statement.

Upon recording the statement, the Bribery Commission filed action against the Defendant in the year 2015.

However, same was withdrawn due to a technical defect and subsequently, an action was instituted in the High Court and same is pending.

In the Plaint filed by Dilrukshi Dias Wickramasinghe, it is stated that on 16.07.2020, after giving evidence at the Bribery Commission, the Defendant had made a statement to the effect that the former Bribery Commission Director General has misled court and has instituted action against him and thereby for well over 5 years, he has been harassed.

In the Plaint it was also stated that, due to the said false and defamatory statement, the former Bribery Commission Director General has been humiliated and insulted as a professional and as a person and that the unblemished character she had built over the years as a government servant had been tarnished owing to the said statement by the Defendant and accordingly, she had suffered loss and damage estimated at Rs.1 Billion.

Having heard the submissions made by the Plaintiff's counsel, court ordered to issue summons and notice of interim injunction on the Defendant, returnable on 29.11.2022.
