Court of Appeal issues interim-injunction on Avant-Garde case

Colombo (News 1st);  The Court of Appeal on Friday (31) issued an interim injunction preventing the examination of the case filed with the Colombo High Court against Retired Major General Palitha Fernando and Chairman of Avant-Garde Nissanka Senadhipathi.

The case was filed by the Commission to Investigate Allegations of Bribery or Corruption and the order was delivered after considering an appeal filed by Nissanka Senadhipathi.

The order was made by Court of Appeal Justices Kumuduni Wickremesinghe and Devika Abeyratne and it will be in effect until the final decision is made on the petition filed with the Court of Appeal.

Further, court ordered for notice to be served on the respondents to appear in court on the 02nd of September.

In his application, Nissanka Senadhipathi claims the Commission to Investigate Allegations of Bribery or Corruption had filed the case without the written approval of all three commission members and therefore requests for the Court of Appeal to issue an order citing the case cannot proceed due to such reasons.

The case was filed against Nissanka Senadhipathi and Palitha Fernando for allegedly soliciting a bribe of 35.5 Million Rupees to grant permission for Avant-Garde Maritime Services to operate a floating armory.
