COLOMBO (News 1st) - A petition was filed today (March 12) against the bill brought in to introduce a three-man high-court. The petition declares that the aforementioned court is unconstitutional.
The Draft Amendment Bill of the Judicature Act was presented to Parliament on the 7th of March. The draft Bill presented may be challenged within two weeks at the Supreme Court.
Parliamentarian Dinesh Gunawardena submitted the petition today (March 12).
According to UPFA Parliamentarian Dinesh Gunawardena, the basic essence of this bill, the amendment that they are about to introduce to the Judicial Organisation, is the establishment of a three-man high court.
Further, he stated that as to who may have cases filed against them at this high court is completely down to the Attorney General and the Director General of the Fraud Bureau.
“By letting two people decide who the cases are filed against, the executive is allowed to target one individual. A law must apply to all equally.”
Parliamentarian Gunawardena also stated that if there is a procedure allowing certain people to be targeted, and if everyone is not treated equally, there is a violation of rights. Thus, the constitution is also violated. This case is being filed citing these and a few more issues.
