Fine imposed for illegally using PE+ trademark

Colombo (News 1st): The Ratnapura Additional Magistrate imposed a fine against a commercial entity that was engaged in the illegal distribution of products using the PE+ registered trademark. PE Plus (Pvt) Ltd was the complainant against the unlawful usage of its trademarks and brand logo being used by a commercial entity for the distribution and sale of diamond cutting discs. Lawyers representing PE Plus (Pvt) Ltd had presented facts to court that the said commercial entity had violated provisions of the Intellectual Property Act and misled the general public. It was further submitted that this resulted in unfair competition in terms of the intellectual property act of Sri Lanka and that it violated the legal rights of the PE+ trademark and brand name. The officers of the commercial entity who refused to accept the accusations in several instances previously, pleaded guilty in court today. Accordingly, Additional Magistrate Dulan Weerawardena imposed a fine of Rs. 100, 000 and ordered that the fake products be destroyed under the supervision of the court. This was one of the highest fines imposed under the intellectual property act of Sri Lanka.
