Colombo (News 1st); The Kurunegala Mayor filed a writ petition with the Court of Appeal seeking an order to prevent the enforcement of the warrant issued for his arrest.
The Kurunegala Police Headquarters Inspector, OIC of the Special Investigations Division, Acting Inspector General of Police, Director General of Archaeology, the Kurunegala Chief Magistrate and the Attorney General were named as respondents in the petition.
The petitioner noted police had obtained a warrant from court on the 07th of August to arrest him based on the directions given by the Attorney General adding the investigation process and the process to obtain the warrant was in violation of the law.
The Kurunegala Mayor requests the Court of Appeal to issue an interim injunction on the respondents preventing any attempt to arrest him until the petition is taken up for examination and a verdict is delivered.
He also requested the Court of Appeal to issue an order to state the respondents cannot take legal action against him under the Antiquities Ordinance as there is no credible information to claim the building at the center of the case is of any archaeological value.
