Several petitions were filed in the Court of Appeal seeking that the four army personnel arrested over the disappearance of journalist Prageeth Eknaligoda be produced before the Magistrate’s Court on Tuesday, September 29.
The petitions were filed by the spouses of the four arrested army officers. The Habeas Corpus applications were taken up before Court of Appeal President Vijith Malalgoda and Justice H.C.J. Madawala.
The petitioners stated that their husbands had been arrested over the disappearance of Eknaligoda and are being continuously held under detention orders, without being produced before a magistrate’s court.
The petitions go on to state that whilst the officers were being held under the Prevention of Terrorism Act, the said act allows the detention of persons who are either suspected of an offence or those who had committed such offence, and not those who were not involved in any offence.
Taking these facts into consideration, Court issued notices on the CID, the former and present secretaries of defence, the IGP and Attorney General to appear before court on October 9.
