Democratic Party decision to remove councillors was unlawful: Appeal Court

The Court of Appeal has held the decision taken by the Democratic Party to remove three provincial councillors, as unlawful.

The petition was filed by Western Provincial Councillor Ashoka Dayaratne, Southern Provincial Councillor Padmasiri de Silva and North Western Provincial Councillor Malhaami Ratnayake.

The case was taken up before President of the Court of Appeal, Justice Vijith Malalgoda, and Justices Kumudini Wickramasinghe and S.H. Madawala.

The Provincial Councillors were removed from the Democratic Party, when they decided to support Mahinda Rajapaksa during the January presidential election.

The MPs challenged the decision by way of a petition seeking an order nullifying the party’s decision
