Mangala’s case: homosexuality or unnatural sexual activity – Priyankara is clearly victim, says Attorney

Various criticisms have been levelled in recent days by MP Mangala Samaraweera’s faction, over President’s Counsel Hemantha Warnakulasuriya, representing a youth who was arrested on suspicion of having stolen several items from MP Samaraweera’s residence.

The youth who was later released on bail, had lodged a counter complaint with Police Headquarters claiming that he had been arrested on false charges.

Attorney-at-Law Jeevani Kariyawasam, a junior of President’s Counsel Hemantha Warnakulasuriya, made clarifications to the media regarding the youth’s legal representation.

UNP Parliamentarian, Mangala Samaraweera made this statement on  27.01.2014

“This person who is supposedly a President’s Counsel and never appears for minor incident without charging more than 500,000 rupees has suddenly run to Panadura with six lawyers to represent this individual. I think this is something that should go into the Guinness Book of World Records because I believe it is the first time that a President’s Counsel has appeared for a minor criminal or what we call a Cat Burglar in English.”

Junior to Hemantha Warnakulasuriya PC, Attorney-at-Law Jeevani Kariyawasam expressed these views;

Whether it be due to homosexuality or unnatural sexual activity, the individual who has been victimised, is clearly the victim. Therefore, as lawyers, representing victims or the party who has been done an injustice, is a professional matter. In this chain of incidents, the suspect Shivan Priyankara, his wife and their eight-month-old daughter are clearly the victims. We are representing them.”

She added; “When Shivan Priyankara’s wife went to the relevant institutions to reveal the injustice she was subjected to face rejection. She has noted this fact in her affidavit. As a woman and lawyer who speaks about laws which affect women, this was a matter that caused me great distress. I felt that I must support her fight. This case is clearly about human rights and standing on behalf of this person’s rights. If some person is interpreting this chain of events and matters related to  as an opportunity that has been taken to sling mud at someone, then I believe that it is clearly an unfortunate matter relating to this social situation.”
